Texas Spousal Maintenance Requirements

Texas Family Code Chapter 8 sets specific requirements for court-ordered spousal maintenance. A spouse seeking maintenance generally must show that, after the divorce, the spouse will lack sufficient property, including separate property, to provide for minimum reasonable needs. Minimum reasonable needs refers to the amount required for reasonable living expenses based on the circumstances, not necessarily the marital standard of living.

Who May Qualify for Spousal Maintenance?

Meeting the minimum-reasonable-needs threshold is only the first step. The spouse requesting maintenance must also establish an applicable statutory basis.

Eligibility may involve:

• A qualifying family-violence conviction or deferred adjudication during the marriage or within the statutory period.
• An incapacitating physical or mental disability that prevents the spouse from earning enough income.
• A marriage lasting at least 10 years when the spouse lacks the ability to earn sufficient income for minimum reasonable needs.
• Custody of a child of the marriage who requires substantial care and personal supervision because of a physical or mental disability.

For the 10-year marriage pathway, Texas law creates a rebuttable presumption against maintenance unless the requesting spouse exercised diligence to earn sufficient income or develop necessary employment skills while the divorce was pending and, when applicable, during separation. A rebuttable presumption is a legal assumption that can be overcome with sufficient evidence.

Factors Courts Consider After Eligibility

Establishing eligibility doesn’t guarantee an award or determine its amount. The court separately evaluates evidence concerning both spouses’ finances and circumstances.

Relevant factors can include:

• Each spouse’s ability to provide for minimum reasonable needs.
• Education, employment skills, work history, earning ability, and the time needed for training.
• The marriage’s duration and each spouse’s age, physical condition, and emotional condition.
• Property awarded in the divorce and each spouse’s separate financial resources.
• Child-support obligations and caregiving responsibilities.
• Contributions to the other spouse’s education, training, or increased earning power.
• Excessive or abnormal spending, concealment, or destruction of community property.

Evidence may include pay records, tax documents, employment history, monthly expense records, education and training information, medical documentation, asset information, and proof of household or caregiving contributions. The evidence needed depends on the eligibility pathway and the disputed financial issues.

Maintenance Amount & Duration Limits

Texas caps monthly court-ordered maintenance at the lesser of $5,000 or 20% of the paying spouse’s average monthly gross income. This is a maximum, not an amount automatically awarded. The court considers the evidence and statutory factors when determining whether a lower amount is appropriate.

Except when a statutory exception applies, maintenance may last no longer than five years for a qualifying marriage of at least 10 but not more than 20 years, seven years for a marriage of at least 20 but not more than 30 years, or 10 years for a marriage lasting 30 years or more. The court must generally use the shortest reasonable period that allows the recipient to earn enough income for minimum reasonable needs.

A longer period may apply when a disability, responsibility for an infant or young child, or another compelling impediment substantially or completely limits the recipient’s earning ability. The facts and current Texas law determine the applicable duration.

Modification, Termination & Enforcement

A court may modify a maintenance order after a material and substantial change in circumstances occurring after the order or divorce decree. A modification generally affects payments accruing after the motion is filed, so a change in circumstances doesn’t automatically alter the existing obligation.

Court-ordered maintenance may terminate under statutory conditions, including the death of either party, the recipient’s remarriage, or a court finding of qualifying continuing cohabitation. Unpaid amounts can become arrearages and may be enforced through a judgment, income withholding, or contempt when authorized by law.

Contractual alimony is different because it arises from the spouses’ written agreement. Questions about changing, ending, or enforcing contractual payments often depend on the agreement’s exact language as well as applicable Texas law. The controlling agreement or court order should be reviewed before action is taken.
